1. 1. Participation in promotion. Participation of eligible individuals or entities (“Participant”) in the Adam Quenneville Roofing Snowfall Promotion (“Promotion”) entitles the Participant to a refund in the amount of the full purchase price, excluding sales tax, finance/bank charges, and subsequent change orders (“Purchase Price”) for any “Qualified Purchase” the Participant made during the “Promotional Period”, if it snows eight inches (8”) or more at Westover Air Force Base in Chicopee, MA on February 14, 2022, between the hours of 1201am EST and 1159pm EST (“Snowfall Accumulation”), as determined by the “Independent On Site Weather Observer.”
   2. Promotion Eligibility. By signing these Promotion rules (“Rules”) you are agreeing to participate in the Promotion and comply with all of the Rules as described herein. Any Participant who does not comply with the Rules as described herein is ineligible to participate, or claim any refund for the Purchase Price, in the Promotion.
   3. Promotion Eligibility Requirements. To be eligible to participate in the Promotion, Participant must make a “Qualified Purchase” during the “Promotional Period” and opt in to the Promotion by signing a copy of these Rules, returning the signed copy to Adam Quenneville Roofing, and complying with the Rules in their entirety.
      1. A “Qualified Purchase” is defined as a non-refundable (unless refund is made under the Promotion due to Snowfall Accumulation) purchase by Participant from Adam Quenneville Roofing where the Purchase Price exceeds $3,500 including labor, but excluding sales tax, finance/bank charges, or subsequent change orders, and the purchase includes at least one of the following items:
         1. Any Roofing Service including Repair, Replacement, Installation of a Roofing System such as Gutters or Ice-Dam Management
         2. Siding Installation or other Siding Services
      2. and must be scheduled for installation at Participant’s chosen location by Adam Quenneville Roofing, with payment received in full (or non-cancelable payment schedule confirmed) by Adam Quenneville Roofing, before the end of the Promotional Period.
      2. The “Promotional Period” starts on January 1, 2022, and ends on January 31, 2022. Participant must make a Qualified Purchase and have it scheduled for installation, with payment either received in full or non-refundable payment schedule confirmed by Adam Quenneville Roofing, all during the Promotional Period.
   4. Snowfall Accumulation Determination. Whether the required Snowfall Accumulation occurred (the “Determination”) will be determined by the “Independent OnSite Weather Observer,” Athenium Analytics, a neutral third party consulting meteorologist, whose Determination will be final. In the event that the Independent OnSite Weather Observer is unable to provide the Determination regarding the Snowfall Accumulation, the Determination will be made by the third party insurer which Adam Quenneville Roofing has obtained insurance thru for the Promotion (the “Third Party Insurer”) by obtaining measurements for the Snowfall Accumulation from the National Weather Service station closest to Westover Air Force Base in Chicopee, MA.
   5. Refund Claim Process
      1. If the Determination is made that the required Snowfall Accumulation occurred, Adam Quenneville Roofing will notify Participants who have complied with the Promotion rules within 48 hours of the Determination being made by posting a notice on its Facebook page (facebook.com/1800newroof) and website (www.1800newroof.net). It may take a week after the Snowfall Accumulation for the Determination to be made.
      2. After the Determination is first communicated to Participants by posting on Adam Quenneville Roofing Facebook page and website, Participants will have 30 days to download a Snowflake Promotion Refund claim form (“Claim Form”) from www.1800newroof.net, fill out the Claim Form in its entirety, sign it, and return it to Adam Quenneville Roofing as specified therein. Participants who do not submit a Claim Form within 30 days of the Determination being posted, will be in violation of these Rules and will lose their right to participate in the Promotion and claim a refund of the Purchase Price.
   6. Payment of Refund. If a Determination is made that the required Snowfall Accumulation occurred, and such Determination is accepted by the Third Party Insurer resulting in the payment of claims to Adam Quenneville Roofing by the Third Party Insurer, Adam Quenneville Roofing will pay eligible Participants who have submitted a Claim Form a refund on their Purchase Price within 60 days of the submission of the Participant’s Claim Form. For Participants who have not fully paid their balance, they will be refunded all paid portions of the Purchase Price and their invoice will be credited for the remainder.
   7. Adam Quenneville Roofing reserves the right to end the Promotion at any time, without notice, and accept the participation of only those Participants who were eligible prior to the termination of the Promotion.
   8. Use of contest information. All Promotion information and entries submitted by Participants becomes the property of Adam Quenneville Roofing, which reserves the right to use any and all information related to the Promotion, including submissions provided by the contestants, for editorial, marketing and any other purpose, unless prohibited by law.
   9. No endorsement by Facebook. By participating in this contest, you acknowledge that this contest is in no way sponsored, endorsed or administered by, or associated with, Facebook and release Facebook from any and all liability arising from or related to this contest. The information you are providing for this contest is being provided to Adam Quenneville Roofing and not to Facebook, and will be used to communicate with you, and to inform you about special offers from Adam Quenneville Roofing and its affiliates.
